This Shipping & Delivery Policy (“Policy”) applies to all purchases, pre-orders, reservations, limited releases, merchandise orders, beverage orders, promotional products, ambassador products, affiliate-related products, event-related products, collectible products, and all other physical goods purchased, reserved, accessed, or otherwise obtained through Banditos Energy and any associated ecommerce platforms, digital environments, affiliated domains, promotional campaigns, partner activations, or related sales channels operated by Dutch Business Sales Company B.V., trading under the name Banditos Exclusive Beverage and operating under the brand name Banditos Energy (“Banditos”, “Company”, “we”, “us”, or “our”). This Policy forms an integral part of the Company’s broader legal framework, including but not limited to the Terms of Service, Return & Refund Policy, Privacy Policy, Beverage Safety Disclaimer, Affiliate Terms, Earnings System Agreement, and any additional policies, legal notices, disclaimers, campaign terms, or platform conditions published by the Company from time to time. By placing an order, completing a purchase, participating in a product release, joining a pre-order campaign, reserving inventory, accessing checkout functionality, or otherwise purchasing products from Banditos Energy, the customer acknowledges and agrees to this Shipping & Delivery Policy in full.
1. GENERAL SHIPPING INFORMATION
Banditos Energy operates an international ecommerce and lifestyle platform involving beverage products, merchandise, promotional items, automotive lifestyle products, ambassador products, limited edition collections, event-related products, collectible products, and future product categories that may become available through the Company’s ecommerce infrastructure. Shipping operations may involve internal logistics operations, external fulfilment providers, warehouse partners, third-party carriers, distribution intermediaries, customs authorities, and other operational service providers depending on the destination country, product category, shipping method, operational capacity, or release structure applicable at the time of purchase. All shipping timelines, dispatch windows, processing estimates, launch expectations, and operational forecasts communicated through the Platform are indicative estimates only and do not constitute legally binding delivery guarantees unless explicitly required under mandatory applicable law.
2. SHIPPING AVAILABILITY & SALES REGIONS
Energy drink products are currently offered only within the European Union where legally permitted and operationally available. The Company reserves the unrestricted right to limit, suspend, restrict, or refuse beverage sales to specific countries, territories, jurisdictions, regions, or customers at any time without prior notice. Merchandise products, apparel products, accessories, lifestyle products, collectible items, promotional products, ambassador products, and future non-beverage product categories may be offered internationally subject to operational availability, carrier limitations, local regulations, import restrictions, sanctions, customs requirements, or other legal and logistical considerations. Not all products displayed on the Platform are available in all countries or regions. Availability may vary without notice due to inventory allocation, operational limitations, legal restrictions, licensing limitations, carrier restrictions, or regional compliance requirements.
3. ORDER ACCEPTANCE & PROCESSING
Submission of an order through the Platform does not constitute final acceptance of the order by the Company. Orders shall only be deemed accepted after successful payment authorization, internal verification procedures, operational confirmation, inventory validation, fraud screening, and shipment preparation processes have been completed. The Company reserves the unrestricted right to reject, suspend, cancel, limit, or refuse any order or shipment at its sole discretion where reasonably necessary for operational, legal, commercial, anti-fraud, inventory, compliance, safety, payment verification, customs, regulatory, or risk-management purposes. Order processing times may vary depending on operational volume, product category, inventory synchronization, payment verification, warehouse conditions, release schedules, pre-order structures, seasonal demand, carrier capacity, customs procedures, force majeure events, or other operational circumstances. Business days exclude weekends, public holidays, warehouse closures, operational interruptions, and non-operational carrier periods unless explicitly stated otherwise.
4. ORDER VERIFICATION & FRAUD PREVENTION
For security, fraud prevention, payment verification, risk mitigation, or compliance purposes, the Company reserves the right to request additional customer information, identity verification, payment confirmation, address validation, age verification where applicable, or supplemental documentation before processing or dispatching an order. Orders suspected of fraud, abuse, unauthorized payment activity, reseller activity, automated purchasing behavior, manipulation of limited releases, chargeback risk, policy abuse, or other suspicious activity may be delayed, suspended, restricted, or cancelled without liability. The Company reserves the right to limit quantities, restrict repeat purchases, refuse bulk purchasing behavior, or cancel duplicate orders where reasonably necessary to protect operational integrity, inventory fairness, release management, or commercial interests.
5. SHIPPING METHODS & CARRIERS
Banditos Energy may utilize various shipping methods, logistics providers, warehouse operators, courier services, postal networks, fulfilment partners, or third-party transportation providers depending on the destination, shipment type, carrier availability, operational capacity, product category, or release structure. Shipping carriers may include national postal services, international logistics providers, express couriers, freight providers, local last-mile delivery operators, or regional transportation partners. The Company does not guarantee the availability of any specific carrier, delivery service, delivery timeframe, routing method, pickup structure, signature service, or tracking system unless explicitly stated otherwise. Certain shipments may require signature confirmation, age verification, identity verification, pickup-point collection, customs inspection, or additional carrier procedures depending on destination laws, carrier protocols, or shipment risk assessments.
6. DELIVERY ESTIMATES & NON-GUARANTEED TIMELINES
All delivery estimates, dispatch forecasts, release windows, transit timelines, operational expectations, preorder estimates, or shipping projections published by the Company are indicative estimates only and are provided solely for informational purposes. Delivery dates are not guaranteed unless explicitly required under mandatory applicable consumer law. Actual delivery timelines may vary substantially due to carrier operations, customs procedures, public holidays, peak-season volumes, warehouse processing delays, transportation disruptions, labour shortages, strikes, force majeure events, weather conditions, geopolitical developments, technical failures, regulatory inspections, inventory synchronization issues, or other circumstances outside the reasonable control of the Company. No automatic compensation rights, refunds, credits, reimbursements, or cancellation rights shall arise solely due to shipping delays, carrier disruptions, customs processing delays, inventory delays, release postponements, or operational interruptions unless otherwise required under applicable mandatory law.
7. PRE-ORDERS & LIMITED RELEASES
The Company may offer products on a pre-order basis prior to inventory availability, manufacturing completion, warehouse intake, launch activation, or official release dates. Pre-order timelines, launch dates, manufacturing estimates, release windows, dispatch forecasts, and projected availability dates are indicative estimates only and may change without notice. Limited releases, collectible drops, event-related products, ambassador collections, promotional campaigns, or high-demand launches may experience inventory shortages, overselling situations, allocation limitations, synchronization delays, technical checkout issues, or release interruptions. Adding products to a shopping cart, wishlist, queue system, checkout session, or reservation interface does not reserve inventory and does not guarantee successful product allocation. The Company reserves the right to cancel, limit, modify, split, postpone, or refuse limited-release orders where reasonably necessary due to inventory shortages, fraud prevention, system limitations, operational disruptions, allocation conflicts, or technical synchronization delays.
8. SPLIT SHIPMENTS
Orders containing multiple product categories, preorder products, merchandise products, beverage products, limited releases, promotional items, or warehouse-specific inventory may be shipped separately at the Company’s discretion. The Company reserves the right to divide orders into multiple shipments without prior notice where operationally necessary or commercially reasonable. Separate shipments may arrive on different dates and through different carriers.
9. INTERNATIONAL SHIPPING
International shipments may be subject to customs procedures, regulatory inspections, import reviews, border delays, transportation restrictions, carrier limitations, local compliance checks, and other governmental processes outside the control of the Company. Transit timelines for international shipments are inherently variable and may substantially exceed initial estimates depending on destination-specific conditions. Customers acknowledge that international ecommerce transactions may involve additional risks, delays, governmental controls, import restrictions, or carrier limitations beyond the Company’s reasonable control.
10. CUSTOMS, IMPORT DUTIES & TAXES
Unless explicitly stated otherwise by the Company or required under applicable law, all customs duties, import taxes, VAT obligations, excise duties, clearance fees, handling charges, brokerage costs, local compliance costs, regulatory fees, governmental assessments, or other import-related charges remain solely the responsibility of the customer. Customers are solely responsible for ensuring that ordered products may legally be imported, possessed, distributed, consumed, or used within their jurisdiction. Customs authorities, border agencies, food safety authorities, transportation regulators, or governmental bodies may delay, inspect, reject, confiscate, destroy, return, or seize shipments in accordance with local laws and regulations. The Company shall not be liable for customs-related delays, import refusals, seizure actions, destroyed shipments, rejected imports, denied entry, licensing issues, food compliance restrictions, or additional import-related expenses arising after dispatch.
11. TRACKING INFORMATION
Tracking information may be provided where operationally available and supported by the selected carrier or shipping service. Tracking availability, scan frequency, tracking accuracy, event visibility, delivery confirmations, geolocation updates, and carrier data synchronization may vary depending on the carrier, shipping route, destination country, customs procedures, or operational systems involved. Carrier tracking systems may contain delays, omissions, inaccuracies, temporary interruptions, duplicate scans, missing updates, or premature delivery statuses beyond the Company’s control.
12. FAILED DELIVERIES & RETURNED SHIPMENTS
Shipments that cannot be delivered due to failed delivery attempts, carrier access limitations, refusal of acceptance, absence of recipient, expired pickup periods, customs non-compliance, unpaid import charges, address issues, or other delivery failures may be returned, abandoned, destroyed, or held by the carrier depending on carrier policy and local regulations. Additional shipping costs, return costs, customs costs, storage fees, destruction charges, handling costs, or reshipment expenses resulting from failed deliveries may be charged to the customer where legally permitted. The Company reserves the right to deduct such costs from any eligible refund, store credit, reimbursement, or cancellation amount.
13. INCORRECT SHIPPING INFORMATION
Customers remain solely responsible for providing complete, accurate, accessible, and deliverable shipping information at the time of purchase. The Company shall not be liable for delays, failed deliveries, returned shipments, customs issues, additional carrier costs, lost shipments, or delivery complications resulting from incomplete, inaccurate, outdated, inaccessible, or incorrectly submitted address information. Address modifications requested after order placement cannot be guaranteed and may not be operationally possible once fulfilment procedures, warehouse processing, or carrier booking procedures have commenced.
14. REFUSED PACKAGES
If a customer refuses delivery of a shipment, fails to collect a shipment, rejects customs clearance obligations, declines import charges, or otherwise prevents successful delivery, the shipment may be returned, destroyed, abandoned, or subject to additional carrier and customs charges. Original shipping costs, carrier surcharges, customs costs, handling fees, operational expenses, return charges, or destruction fees may be deducted from any refund amount where legally permitted. Certain beverage products, consumable products, hygiene-sensitive products, limited releases, or customized items may become non-returnable once shipped or refused.
15. LOST, STOLEN OR DELAYED SHIPMENTS
The Company shall not be liable for shipment delays, delivery interruptions, stolen packages, porch theft, carrier loss events, customs detention, warehouse interruptions, or transit disruptions occurring after handover to the carrier except where liability cannot legally be excluded. Customers must cooperate with commercially reasonable carrier investigations, verification requests, operational reviews, insurance procedures, or claims processes where applicable. Claims relating to missing shipments, damaged products, or delivery disputes may require supporting evidence including photographs, carrier reports, identity verification, proof of non-delivery, or written declarations.
16. RISK OF LOSS & TRANSFER OF RESPONSIBILITY
To the maximum extent permitted under applicable law, risk of loss, accidental damage, delay, theft, or destruction transfers to the customer upon transfer of the shipment to the applicable carrier, logistics provider, transportation partner, or fulfilment intermediary. Where mandatory consumer laws impose alternative transfer rules, such mandatory legal provisions shall prevail solely to the extent required by law.
17. THIRD-PARTY LOGISTICS PROVIDERS
The Company may utilize external fulfilment centres, warehouse operators, transportation providers, distribution partners, software providers, logistics intermediaries, customs brokers, or other third-party operational service providers to facilitate storage, packaging, dispatch, transportation, delivery, customs processing, inventory synchronization, or operational fulfilment activities. Operational performance of such third-party providers may affect shipment timelines, tracking visibility, routing structures, delivery sequencing, customs procedures, or dispatch operations. The Company does not guarantee uninterrupted performance of third-party operational systems, logistics infrastructure, or transportation networks.
18. FORCE MAJEURE & OPERATIONAL DISRUPTIONS
The Company shall not be liable for delays, failures, interruptions, losses, or inability to perform shipping obligations caused directly or indirectly by circumstances beyond its reasonable control. Such circumstances may include, without limitation, natural disasters, extreme weather events, floods, fires, pandemics, epidemics, labour shortages, strikes, industrial disputes, transportation disruptions, carrier failures, customs delays, governmental actions, import restrictions, sanctions, civil unrest, cyber incidents, software failures, telecommunications disruptions, power outages, warehouse interruptions, supply-chain shortages, manufacturing interruptions, inventory synchronization failures, armed conflicts, geopolitical instability, terrorism, border closures, fuel shortages, or other force majeure events. During such events, shipment timelines, preorder schedules, release dates, operational estimates, or fulfilment expectations may be suspended, extended, modified, or cancelled without liability.
19. PRODUCT AVAILABILITY & INVENTORY LIMITATIONS
All products are offered subject to availability. Inventory systems, warehouse synchronization systems, ecommerce integrations, payment systems, preorder allocations, and release-management systems may experience delays, overselling situations, technical interruptions, duplicate reservations, or synchronization inaccuracies. The Company does not guarantee continuous product availability and reserves the right to limit quantities, cancel orders, modify allocations, suspend releases, or discontinue products without notice.
20. LIMITED EDITION DROPS & HIGH-DEMAND RELEASES
Limited edition releases, event products, ambassador collections, collectible products, collaborations, promotional products, automotive lifestyle products, and high-demand launches may sell out rapidly or become unavailable without notice. Checkout access, cart placement, queue participation, payment submission, or temporary checkout confirmation does not guarantee successful allocation of inventory. The Company reserves the right to implement quantity limits, anti-bot protections, fraud-prevention systems, order reviews, randomized allocation procedures, or release restrictions where commercially reasonable.
21. ADDRESS CHANGES & ORDER MODIFICATIONS
Once an order has entered warehouse processing, fulfilment preparation, dispatch sequencing, carrier booking, or shipment packaging procedures, modifications may no longer be operationally possible. The Company does not guarantee cancellation requests, address changes, shipment rerouting, carrier interception requests, or order modifications after submission. Operational attempts to accommodate customer modification requests shall not create any obligation to do so.
22. SHIPPING RESTRICTIONS
The Company reserves the right to prohibit shipments to certain countries, territories, jurisdictions, individuals, organizations, forwarding services, commercial resellers, freight forwarders, or restricted regions where necessary for legal, operational, regulatory, safety, anti-fraud, compliance, carrier, customs, or commercial reasons. Energy drink shipments may be restricted in jurisdictions where caffeinated beverages, food imports, ingredient regulations, labelling rules, excise obligations, or local compliance requirements impose limitations.
23. COMPLIANCE WITH LOCAL LAWS
Customers are solely responsible for ensuring compliance with all local laws, regulations, import rules, food regulations, customs requirements, age restrictions, licensing obligations, taxation rules, and product restrictions applicable within their jurisdiction. The Company makes no representation that products available through the Platform are lawful, compliant, permitted, approved, or importable in every country or jurisdiction.
24. LIABILITY LIMITATIONS
To the maximum extent permitted under applicable law, the Company disclaims liability for indirect losses, consequential damages, incidental damages, lost profits, commercial losses, reputational damages, missed events, operational disruptions, customs losses, delayed shipments, transportation interruptions, or third-party carrier failures arising from or related to shipping, transportation, delivery, customs processing, inventory allocation, preorder delays, operational disruptions, or fulfilment activities. Nothing in this Policy shall exclude or limit liability where such exclusion is prohibited under mandatory applicable law.
25. POLICY CHANGES
The Company reserves the right to modify, update, amend, replace, suspend, or revise this Shipping & Delivery Policy at any time without prior notice. The most current version published on the Platform shall govern all purchases and shipping activities unless otherwise required under applicable law.
