RETURN & REFUND CONDITIONS

This Return, Refund & Cancellation Policy (“Policy”) applies to all purchases made through Banditos Energy and any related ecommerce environments, promotional campaigns, limited releases, ambassador activations, affiliated online stores, and digital sales channels operated by Dutch Business Sales Company B.V., trading under the name Banditos Exclusive Beverage and operating under the brand name Banditos Energy (“Banditos”, “Company”, “we”, “us”, or “our”).

This Policy forms an integral part of the Company’s Terms of Service and applies to all customers, purchasers, visitors, users, affiliates, ambassadors, and any other individuals or entities purchasing products or interacting with the Platform internationally. By placing an order through the Platform, the customer acknowledges and agrees to the terms set forth in this Policy.

1. GENERAL RETURN ELIGIBILITY

Subject to applicable mandatory consumer protection laws, eligible merchandise products purchased directly through the Platform may be returned within fourteen (14) calendar days following delivery of the applicable order.

In order to qualify for return eligibility, products must remain unused, unworn, unwashed, undamaged, and in their original condition, including all original packaging, tags, labels, inserts, accessories, and protective materials where applicable.

Products that show signs of wear, usage, misuse, washing, contamination, damage, modification, excessive handling, or deterioration beyond what is reasonably necessary to inspect the product may be refused for return eligibility.

Customers are required to contact the Company in advance through customer@banditosenergy.shop prior to returning any product. The Company does not guarantee acceptance of unauthorized, unidentified, or unsolicited return shipments.

Unidentified returns may be temporarily stored for a maximum period of one (1) month pending identification and verification. If the shipment cannot reasonably be identified within that period, the Company reserves the right to process, reject, dispose of, or otherwise handle the shipment without further correspondence, subject to applicable law.

Return shipping costs, including any carrier charges, customs expenses, taxes, import duties, insurance fees, or associated handling costs, shall remain the responsibility of the customer unless otherwise required under applicable law or expressly confirmed otherwise by the Company in writing.

2. RIGHT OF WITHDRAWAL FOR EU CONSUMERS

Where mandatory European consumer protection legislation applies, consumers residing within the European Union may have a statutory right of withdrawal permitting cancellation of eligible distance purchases within fourteen (14) calendar days following receipt of the goods without providing a reason.

To exercise the right of withdrawal, the customer must clearly communicate the decision to withdraw from the purchase agreement by contacting customer@banditosenergy.shop within the applicable withdrawal period.

Following such notification, the customer must return the applicable goods without undue delay and, where legally required, no later than fourteen (14) days after communicating the withdrawal request.

The statutory right of withdrawal may not apply, may be restricted, or may be excluded for certain categories of goods, including but not limited to consumable products, sealed goods that are not suitable for return for health protection or hygiene reasons once opened, customized products, event-related products, promotional items, limited releases, or products specifically designated as non-returnable or final sale where legally permissible.

Nothing contained within this Policy shall limit or exclude any mandatory statutory consumer rights that cannot legally be waived or excluded under applicable law.

3. FOOD & BEVERAGE RETURN EXCEPTIONS

Due to food safety regulations, hygiene standards, quality assurance obligations, storage integrity requirements, and consumer protection considerations, energy drinks, beverages, consumable products, and other ingestible goods are generally non-returnable once delivered.

Opened beverages, unsealed consumables, partially consumed products, or products exposed to external handling conditions may not be eligible for return, exchange, replacement, or refund except where mandatory consumer protection laws require otherwise or where the Company determines, in its sole but reasonable discretion, that a verified manufacturing defect, shipping damage, contamination concern, or incorrect delivery has occurred.

The Company reserves the right to request supporting evidence before reviewing or approving any beverage-related claim, including but not limited to photographs of the affected product, packaging materials, shipping labels, batch numbers, production markings, disposal confirmation, or additional shipment information reasonably necessary to investigate the issue.

4. NON-RETURNABLE PRODUCTS

Unless otherwise required under applicable law, certain products may not qualify for return, refund, exchange, replacement, or withdrawal rights.

Such exclusions may include, without limitation, opened or unsealed beverages, promotional products, complimentary items, giveaway products, limited edition releases, ambassador merchandise, affiliate products, event-exclusive products, personalized items, made-to-order products, digital goods, gift cards, custom-produced items, clearance products, and products designated as non-returnable or final sale.

The Company reserves the right to designate certain collections, campaigns, promotional releases, or inventory allocations as final sale where legally permissible.

5. OPENED, DAMAGED OR USED PRODUCTS

Products returned in a condition inconsistent with their original shipped condition may be refused for refund eligibility. This includes, but is not limited to, products showing evidence of use, wear, washing, physical damage, misuse, contamination, missing components, altered packaging, or deterioration occurring after delivery.

For hygiene, consumer safety, operational, resale, and brand protection reasons, the Company reserves the right to reject return requests where the returned products cannot reasonably be restored to commercially resalable condition.

Where a returned product is determined to be ineligible for refund, the Company may refuse the refund request, issue a partial refund where commercially appropriate and legally permissible, return the product to the customer at the customer’s expense, or dispose of the product where return shipment is commercially unreasonable or restricted under applicable law.

6. ORDER CANCELLATIONS

Customers may request cancellation of an order prior to fulfillment, warehouse processing, shipment preparation, or dispatch. Once an order has entered fulfillment or shipment processing stages, cancellation requests may no longer be possible.

Pre-orders, limited releases, promotional campaigns, event-related inventory, ambassador products, and specially allocated inventory may be subject to additional cancellation restrictions.

Estimated dispatch dates, launch schedules, production timelines, and preorder shipping windows are provided for informational purposes only and shall not constitute binding delivery guarantees unless explicitly stated otherwise by the Company in writing.

The Company reserves the right to cancel, limit, reject, or suspend any order at its reasonable discretion for purposes including, but not limited to, fraud prevention, reseller prevention, inventory protection, pricing corrections, payment verification, regulatory compliance, shipping restrictions, operational limitations, or platform security concerns.

7. DAMAGED, INCORRECT OR DEFECTIVE ORDERS

Customers are responsible for inspecting products promptly upon delivery. If an order arrives damaged, defective, incomplete, or incorrect, the customer should contact customer@banditosenergy.shop as soon as reasonably possible and preferably within seventy-two (72) hours following delivery.

In order to properly assess the claim, the Company may request supporting evidence, including photographs of the outer shipping packaging, shipping labels, damaged products, visible defects, affected merchandise, and any other information reasonably necessary to investigate the reported issue.

Where a claim is validated following review and inspection, the Company may, at its sole but reasonable discretion and subject to applicable law, provide a replacement product, issue a refund, provide store credit, or offer another commercially reasonable resolution.

8. REFUND PROCESSING

Approved refunds are generally issued to the original payment method used during checkout. Once a returned product has been received, inspected, verified, and approved, refunds are typically processed within approximately five (5) to ten (10) business days.

Actual processing times may vary depending on financial institutions, payment providers, regional banking systems, platform processing delays, fraud prevention reviews, or third-party payment infrastructure outside the Company’s reasonable control.

Original shipping costs, carrier charges, customs duties, import taxes, handling costs, payment processing fees, or other non-refundable operational expenses may be excluded from reimbursement where legally permissible.

Refund timelines communicated by the Company are estimates only and shall not constitute guaranteed processing obligations.

9. FAILED DELIVERIES & RETURNED SHIPMENTS

Customers are solely responsible for providing complete and accurate shipping information during checkout.

Where shipments are refused, unclaimed, rejected, undeliverable, returned by customs authorities, or returned due to incorrect address information provided by the customer, the Company reserves the right, where legally permissible, to deduct original shipping costs, return carrier charges, customs expenses, warehouse handling fees, administrative processing costs, and other commercially reasonable operational expenses from any applicable refund.

International shipments may be subject to customs inspections, import restrictions, duties, taxes, regulatory procedures, or regional delivery limitations outside the Company’s reasonable control.

The Company shall not be responsible for customs delays, failed import clearance, governmental seizure, delivery restrictions, or carrier-related disruptions caused by third parties or governmental authorities.

10. THIRD-PARTY RETAILERS & DISTRIBUTORS

Products purchased through third-party retailers, distributors, resellers, independent commercial partners, marketplaces, or event vendors are generally subject to the return, refund, and cancellation policies of the original point of sale.

The Company may not be able to directly process return requests, refunds, exchanges, or withdrawal claims relating to purchases not made directly through the Company-operated ecommerce platform.

11. CHARGEBACKS & FRAUD PREVENTION

The Company actively monitors transactions, return activity, reseller conduct, promotional abuse, payment disputes, and refund behavior for fraud prevention and platform protection purposes.

Fraudulent, abusive, deceptive, manipulative, or bad-faith conduct may result in the refusal of future orders, account suspension, cancellation of pending transactions, refusal of refund requests where legally permissible, or additional verification requirements.

The Company further reserves the right to submit supporting evidence, transaction records, shipment confirmations, customer communications, delivery confirmations, fraud prevention data, and related documentation to payment providers, financial institutions, dispute resolution entities, or relevant authorities in connection with disputed transactions or suspected fraudulent conduct.

12. PROMOTIONAL PRODUCTS, LIMITED RELEASES & EVENT PRODUCTS

Promotional products, complimentary items, giveaway products, launch products, limited edition releases, ambassador merchandise, event-exclusive inventory, and campaign-related products may be subject to separate return, cancellation, exchange, or refund restrictions.

Where legally permissible, certain promotional or limited products may be designated as final sale and may therefore not qualify for cancellation, return, refund, or exchange once purchased, allocated, or shipped.

Minor variations relating to packaging, production batches, artwork, labeling, promotional inserts, collectible presentation elements, or campaign-related design adjustments shall not automatically constitute defects or grounds for refund.

13. REFUSAL OF RETURNS

The Company reserves the right to refuse any return request, refund request, cancellation request, replacement request, or exchange request where the request violates this Policy, where the returned products fail inspection, where evidence is insufficient or inconsistent, where abuse or fraud is reasonably suspected, or where mandatory legal requirements do not require acceptance of the request.

Nothing contained within this section shall limit any mandatory statutory rights granted to consumers under applicable law.

14. LIABILITY LIMITATIONS

To the fullest extent permitted under applicable law, the Company’s liability relating to returned products, refunds, cancellations, shipment delays, defective products, ecommerce transactions, payment disputes, or Platform-related issues shall be limited to the amount actually paid by the customer for the applicable order.

The Company shall not be liable for indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of profits, loss of revenue, business interruption, reputational damage, loss of opportunity, emotional distress, or third-party expenses arising from the use of the Platform or purchased products.

Nothing contained within this Policy shall exclude or limit liability that cannot legally be excluded or limited under applicable law, including liability arising from fraud, intentional misconduct, or gross negligence where such limitation is prohibited.
